Please read these Terms & Conditions carefully before using our services. By contacting us, placing an order, or using any service provided by Ahsan Enterprise, you agree to be bound by these terms. These terms apply to all clients — whether based in Pakistan or anywhere in the world.

1📄 Introduction

These Terms & Conditions ("Terms") govern the relationship between Ahsan Enterprise ("we," "us," "our," "the Agency") and any individual, business, or organization ("you," "the Client") who engages our services, visits our website, or enters into any agreement with us.

By hiring our services — whether via our website, WhatsApp, phone, email, or any other channel — you confirm that you have read, understood, and agree to these Terms in their entirety.

These Terms are effective from April 13, 2024 and apply to all services provided on or after this date. For services contracted before this date, the terms agreed upon at the time of that contract apply.

2⚙️ Our Services

Ahsan Enterprise provides the following professional digital services to clients in Pakistan and worldwide:

Web Development — Custom websites, landing pages, and business sites
WordPress & Shopify Development — E-commerce stores, themes, plugins
Logo & Graphic Design — Brand identity, logos, social media graphics, print materials
Digital Marketing — Facebook Ads, Google Ads, Instagram marketing, campaign management
SEO Optimization — Technical SEO, on-page optimization, link building, local SEO
Web Hosting — Managed hosting, domain registration, SSL certificates, server setup

The exact scope of services for each project is defined in the individual project agreement, proposal, or invoice agreed upon between Ahsan Enterprise and the Client. Services not explicitly listed in the agreed scope are not included and may be subject to additional charges.

3🤝 Orders & Project Agreements

A project commences when both parties have agreed on the scope of work, timeline, and price — confirmed via email, WhatsApp message, or a signed project agreement.

📌 What Constitutes an Agreement:

Written confirmation of project scope and price via email or WhatsApp
Payment of the agreed advance/deposit amount
Signing of a formal project agreement or contract (for larger projects)
Verbal confirmation followed by written summary from our team

We reserve the right to decline any project at our discretion, including projects that conflict with our values, involve illegal activities, or fall outside our expertise. We will communicate this promptly and refund any amounts paid if a project is declined after payment.

Scope Creep: Any changes, additions, or expansions to the originally agreed project scope will require a new written agreement and may result in additional charges and revised timelines. We will always notify you and obtain your approval before proceeding with out-of-scope work.

4💰 Payment Terms

All prices quoted by Ahsan Enterprise are in Pakistani Rupees (PKR) unless specifically agreed otherwise for international clients, in which case prices may be quoted in USD, GBP, AED, or another agreed currency.

💳 Accepted Payment Methods:

Pakistan: Bank transfer, JazzCash, Easypaisa, cash (in-person)
International: PayPal, Wise (TransferWise), bank wire transfer, USDT (crypto)

⚠️

Late Payments: Work will be paused if payment is not received by the agreed due date. Final deliverables, website access, source files, and hosting credentials will not be released until full payment has been received. We reserve the right to charge a late fee of 5% per week on overdue amounts after a 7-day grace period.

All quoted prices are exclusive of applicable taxes unless stated otherwise. International clients are responsible for any taxes, duties, or bank transfer fees applicable in their country.

5🚀 Delivery & Timelines

We are committed to delivering every project on time. Estimated timelines are agreed upon at the start of each project and communicated clearly in our project proposal or agreement.

⚠️

Timeline Dependencies: Delivery timelines assume timely provision of required content, feedback, and approvals by the Client. Delays in client feedback, content submission, or payment may extend the project timeline accordingly. Ahsan Enterprise will not be held responsible for delays caused by the Client's failure to respond or provide required materials.

✅ If we are unable to meet an agreed deadline due to circumstances on our end, we will notify you immediately, provide a revised timeline, and offer appropriate remedies.

6✏️ Revisions & Change Requests

We want you to love the final result. Each service package includes a set number of revision rounds as outlined below. Revisions must be requested within the stated period after delivery.

⚠️

What Counts as a Revision: A revision is a minor change to existing approved work — such as text edits, color adjustments, or small layout changes. Requests that significantly change the approved concept, direction, or scope are considered new work and will be quoted separately.

Additional revision rounds beyond the included allowance will be charged at an agreed hourly or flat rate, which will be communicated before the additional work begins.

7©️ Intellectual Property Rights

Intellectual property rights are an important part of our agreement. Here is how ownership works:

✅ What the Client Owns (After Full Payment):

The final delivered logo, design files, and visual assets created specifically for your project
The website design and custom code developed exclusively for your project
All content and copy written specifically for your project
Full commercial usage rights for all delivered final files

⚠️

Ownership transfers only upon receipt of full and final payment. Until full payment is received, all work — including drafts, concepts, and previews — remains the intellectual property of Ahsan Enterprise. Unauthorized use of unpaid deliverables is a violation of intellectual property law.

📌 What Ahsan Enterprise Retains:

The right to display completed work in our portfolio (unless a specific written NDA prohibits this)
Ownership of any generic tools, frameworks, code libraries, or templates used in delivery
All work in progress, concepts, and drafts that were not selected or approved by the Client
Any proprietary internal processes, methodologies, and know-how used to deliver the work

Third-party assets such as stock images, fonts, icons, WordPress themes, or plugins remain subject to their original license terms. It is the Client's responsibility to ensure proper licensing for any third-party assets used in their project.

8👤 Client Responsibilities

A successful project requires active participation from the Client. By engaging our services, you agree to the following responsibilities:

📌 Your Responsibilities as a Client:

Provide all required content, images, logos, and information in a timely manner
Respond to design concepts, revision requests, and feedback within 5 business days
Ensure that all content and materials you provide do not infringe any third-party intellectual property rights
Ensure that all content is legal, accurate, and not misleading or defamatory
Make payments according to the agreed schedule
Nominate a primary point of contact to avoid conflicting instructions from multiple people
Promptly review and approve deliverables when presented

🚫

Prohibited Uses: You must not use our services for anything illegal, fraudulent, defamatory, discriminatory, or harmful. This includes but is not limited to: illegal businesses, counterfeit products, spam campaigns, phishing websites, or any activity that violates applicable local or international law.

Ahsan Enterprise reserves the right to immediately terminate the project and retain all advance payments if the Client is found to be using our services for any prohibited activity.

9↩️ Refund Policy

We take pride in our work and are committed to client satisfaction. Our refund policy is designed to be fair to both parties.

✅ If you are unhappy with any deliverable, please contact us first. In most cases, we can resolve concerns through additional revisions, adjustments, or a mutually agreed solution without resorting to a refund.

To request a refund, contact us at help@ahsanenterprise.com with your project details. All refund requests will be reviewed within 7 business days.

10🔐 Confidentiality

Both parties agree to treat all project-related information as confidential, including business strategies, financial data, technical details, and any proprietary information shared during the course of the project.

🔒 Confidentiality Commitments:

We will not share your project details, business information, or data with any third party without your written consent
Your project files and data will not be used for any purpose other than delivering your project
We are willing to sign a mutual Non-Disclosure Agreement (NDA) upon request before any sensitive discussions begin
Confidentiality obligations remain in effect during and for 3 years after the project is completed

Portfolio Exception: Unless prohibited by a signed NDA, we reserve the right to display completed work (screenshots, links, descriptions) in our portfolio and on our website as examples of our work. If you require full confidentiality, please inform us and we will sign an NDA accordingly.

11⚖️ Limitation of Liability

Ahsan Enterprise's total liability to any Client for any claim arising out of or in connection with our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

Ahsan Enterprise shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to: loss of profits, loss of business, loss of data, damage to reputation, or any other indirect losses — even if we had been advised of the possibility of such damages.

📌 We Are Not Responsible For:

Third-party platform outages (Facebook, Google, Instagram, WordPress.com, etc.)
Changes to search engine algorithms that affect SEO rankings after delivery
Ad account suspensions by Facebook, Google, or other platforms due to policy violations by the Client
Loss of data due to Client-side actions after project handover
Hosting downtime caused by factors outside our control (DDoS attacks, datacenter outages, etc.)
Results of digital marketing campaigns (we optimize for best results but cannot guarantee specific outcomes)

12🛡️ Warranties & Disclaimers

Ahsan Enterprise warrants that all services will be delivered with reasonable skill, care, and professionalism in accordance with the agreed project scope.

✅ What We Guarantee:

All work is original and created by our team (unless agreed third-party assets are used)
Websites are tested for functionality across major browsers and devices before delivery
30-day post-launch support for bugs or technical issues caused by our development work
All work will comply with the agreed project brief and specifications

⚠️

No Guarantee of Results: We do not guarantee specific business outcomes such as a certain number of leads, sales, website traffic, or search engine rankings. Digital marketing and SEO involve many variables outside our control. We commit to applying our best expertise and effort to achieve the best possible results.

13🔚 Termination

Either party may terminate a project agreement under the following conditions:

📌 Termination by the Client:

The Client may terminate the project at any time with written notice
Payment is due for all work completed up to the termination date
The advance payment is non-refundable if work has already commenced
Partially completed deliverables will be provided upon full settlement of outstanding amounts

📌 Termination by Ahsan Enterprise:

We reserve the right to terminate a project if: payment is not received within 14 days of due date
The Client repeatedly fails to provide required content or feedback, causing significant delays
The Client uses our services for illegal or prohibited activities
The relationship becomes non-functional despite reasonable attempts to resolve issues

Upon termination by Ahsan Enterprise due to Client breach, all outstanding payments become immediately due. Refunds, if any, will be calculated based on work completed and costs incurred.

14🏛️ Disputes & Governing Law

We always aim to resolve any disputes amicably and professionally. In the event of a disagreement, we request that you contact us directly first to seek a mutually acceptable resolution.

📌 Dispute Resolution Process:

Step 1 — Direct Communication: Contact us via email or WhatsApp to discuss the issue. Most disputes are resolved at this stage.
Step 2 — Formal Written Complaint: If unresolved, submit a formal written complaint to help@ahsanenterprise.com. We will respond within 10 business days.
Step 3 — Mediation: Both parties agree to attempt mediation through a mutually agreed neutral mediator before pursuing legal action.
Step 4 — Legal Action: If mediation fails, disputes will be subject to the jurisdiction and courts of Karachi, Pakistan.

These Terms are governed by the laws of the Islamic Republic of Pakistan. For international clients, while we respect and honor applicable international consumer protection laws in your jurisdiction, Pakistani law governs the contractual relationship between us.

✅ In our 8+ years of operation, we have resolved all client concerns directly and professionally. We are committed to fair dealings and transparent communication at every stage.

15📝 Changes to These Terms

Ahsan Enterprise reserves the right to update or modify these Terms & Conditions at any time. When changes are made:

The "Effective Date" at the top of this page will be updated
Significant changes will be announced on our website homepage
Active clients will be notified via email or WhatsApp for changes that materially affect ongoing services

Your continued use of our services after any changes to these Terms constitutes acceptance of the revised Terms. If you do not agree with any updated Terms, you must discontinue use of our services and notify us in writing. The latest version of these Terms is always available at ahsanenterprise.com/terms-and-conditions/.
